These Terms & Conditions (“Terms”) govern your use of the Papageno Resort website and any booking, reservation, or purchase made through it (collectively, the “Services”). By accessing our website or making a reservation, you agree to these Terms.
If you do not agree with these Terms, please do not use our website or Services.
1. About Us
Papageno Resort and Dive (“Papageno”, “we”, “us”, or “our”) operates an eco-retreat and dive resort located at Malawai Bay, Kadavu Island, Fiji.

2. Eligibility & Use of Website
You agree to use our website only for lawful purposes. You must not:
- misuse the website or attempt unauthorised access to systems or data
- introduce viruses or malicious code
- copy, scrape, reproduce, or commercially exploit website content without written permission
We reserve the right to suspend or restrict access to the website at any time in order to protect security, maintain systems, or improve services.
3. Bookings & Reservations
3.1 Booking Confirmation
A reservation is confirmed only when:
- written confirmation has been issued by us (email confirmation is sufficient), and
- any required payment or deposit has been received.
3.2 Rates & Inclusions
Rates may include accommodation and additional inclusions as specified at the time of booking. Inclusions vary by package and will be confirmed in writing.
3.3 Minimum Stay & Peak Periods
Minimum stay requirements may apply during peak seasons or special periods.
A minimum three-night stay is required to qualify for complimentary airport boat transfers.
Bookings shorter than three nights may incur additional transfer charges.
3.4 Special Requests
We will make reasonable efforts to accommodate dietary requirements, room preferences, and other special requests. However, these cannot be guaranteed and may incur additional charges.
4. Payments
4.1 Deposits
A deposit may be required to secure a booking. Remaining balances must be paid before the scheduled arrival date unless otherwise agreed.
4.2 Currency
Prices shown on online travel agencies (OTAs) are generally listed in USD.
Local bookings may be charged in FJD unless otherwise specified.
4.3 Taxes & Government Fees
Applicable taxes, government levies, or service charges may apply. If these change due to regulatory updates, we reserve the right to adjust the total charges accordingly.
5. Cancellations, Changes & No-Shows
5.1 Guest Cancellations
Cancellation policies may vary depending on seasonality, booking channel, availability, or travel restrictions. Guests should confirm the applicable cancellation policy at the time of booking.
5.2 Booking Changes
Changes to travel dates, guest names, or packages are subject to availability and may incur additional fees.
5.3 No-Shows & Early Departures
Guests who fail to arrive (no-shows) or depart earlier than the confirmed departure date may be charged for the full duration of the original reservation.
Cancellations made on the day of arrival will be treated as a no-show.
6. Check-In & Check-Out
Check-in: 12:30 PM – 5:00 PM
Check-out: 10:00 AM
Early check-in or late check-out may be available upon request and may incur additional charges.
7. Travel to Kadavu & Transfers
Papageno Resort is accessible primarily by boat. Travel to the resort may involve domestic flights, charter aircraft, seaplane transfers, and boat transfers.
7.1 Guest Responsibility
Guests are responsible for:
- booking and confirming all international and domestic flights
- complying with airline baggage restrictions (including dive equipment)
- arriving on time for scheduled transfers
7.2 Weather & Sea Conditions
Transfers and excursions are dependent on weather, tides, and sea conditions. For safety reasons, we may delay, reroute, reschedule, or cancel transfers or activities.
Any additional accommodation or travel costs resulting from circumstances beyond our control may be the responsibility of the guest.
7.3 Missed Transfers
If a scheduled transfer is missed due to delayed flights, itinerary changes, or other circumstances, additional transport costs may apply.
8. Connectivity & Utilities
Papageno Resort operates as an eco-retreat, powered primarily by solar and micro-hydro systems with generator backup.
Guests acknowledge that:
- Wi-Fi connectivity may be limited or intermittent
- power, hot water, or utilities may occasionally be affected by weather or maintenance
- remote island supply chains may impact availability of certain items
9. Health & Medical Disclaimer
9.1 Limited Medical Access
Kadavu Island is a remote destination and Papageno Resort does not operate a full medical clinic on site. Emergency response times may be longer than in urban areas.
9.2 Guest Responsibility
Guests are responsible for ensuring they are medically fit to travel to a remote location and participate in activities including swimming, hiking, boating, diving, snorkelling, fishing, or cultural excursions.
9.3 Medications
Guests should bring all necessary medications and medical supplies as access to pharmacies and specialist care may be limited.
9.4 Travel Insurance
Comprehensive travel insurance is strongly recommended, including coverage for:
- medical treatment
- emergency evacuation and repatriation
- trip cancellation or interruption
- diving or adventure activities (where applicable)
10. Accessibility
Due to natural terrain, stairs, uneven paths, boat access, and infrastructure, Papageno Resort is not wheelchair accessible and may not be suitable for guests with limited mobility.
By making a booking, you acknowledge these limitations.
11. Diving & Water Activities
11.1 Certification
Certain diving activities require appropriate certification. Guests must provide proof where required.
11.2 Safety Compliance
Guests must follow all safety briefings and instructions from resort staff and guides. We reserve the right to restrict participation if safety concerns arise.
11.3 Medical Forms
Some activities may require completion of medical questionnaires or doctor clearance.
11.4 Marine Conditions
Marine wildlife encounters, visibility, and dive conditions vary by season and cannot be guaranteed.
12. Guest Conduct
To maintain a respectful and peaceful environment, guests agree to:
- treat staff, villagers, and other guests with respect
- comply with safety rules, cultural protocols, and environmental guidelines
- refrain from illegal drug use or disruptive behaviour
We reserve the right to require guests to leave the property without refund if behaviour threatens safety, damages property, or violates these Terms.
13. Children
Children are welcome at the resort. Parents or guardians are responsible for supervising children at all times, particularly near water, docks, boats, and natural terrain.
14. Environmental Responsibility
Papageno Resort follows eco-conscious practices. Guests agree to:
- respect coral reefs and marine life
- avoid touching coral or removing shells
- use reef-safe sunscreen where possible
- follow resort waste disposal and recycling guidelines
15. Property Damage
Guests are responsible for any damage caused by themselves or members of their party beyond normal wear and tear. Repair or replacement costs may be charged to the card on file.
16. Photography & Marketing
Photographs or videos may occasionally be taken on resort property for marketing purposes. If you do not wish to appear in promotional material, please inform us in writing during your stay.
Guests should seek permission before photographing staff or local villagers in a manner that may be intrusive or culturally inappropriate.
17. Intellectual Property
All website content including text, images, branding, logos, and design elements are owned by or licensed to Papageno Resort and may not be reproduced or used commercially without written permission.
18. Third-Party Services
Our website may contain links to third-party platforms such as airlines, booking systems, or social media. We are not responsible for their content, policies, or services.
19. Limitation of Liability
To the fullest extent permitted by law:
- our website and information are provided “as is”
- we do not guarantee uninterrupted or error-free service
- we are not liable for disruptions caused by events beyond our control including weather, transport delays, natural events, or government restrictions
We are not liable for indirect or consequential losses such as missed connections, additional travel costs, or loss of enjoyment, except where required by law.
Nothing in these Terms excludes legal rights that cannot be excluded under applicable consumer protection laws.
20. Force Majeure
We are not responsible for failure or delay in performing obligations where such delay results from events beyond our reasonable control, including:
- severe weather
- natural disasters
- pandemics
- civil unrest
- government restrictions
- transport disruptions
- infrastructure or utility failures
In such cases we may offer rescheduling, credit, or alternative arrangements where possible.
21. Privacy
Papageno Resort respects your privacy and is committed to protecting personal information provided when using our website or Services.
We may collect personal information such as:
- contact details
- booking and travel information
- payment details required for transactions
- communication records related to inquiries or bookings
Information may be used to:
- process reservations and payments
- communicate about bookings or travel arrangements
- improve our services and website functionality
- send occasional updates or promotional information
We do not sell or rent personal information. Information may be shared only where necessary to process bookings, arrange services, or comply with legal obligations.
